What does OSHA require for toilets on a construction site?
OSHA 29 CFR 1926.51(c) requires toilets on construction sites based on crew size. A site with 20 or fewer workers needs at least 1 toilet. A site with 20 or more needs 1 toilet seat and 1 urinal per 40 workers. A site with 200 or more needs 1 seat and 1 urinal per 50 workers.
| Number of employees | Minimum facilities (Table D-1) | Example |
|---|---|---|
| 20 or fewer | 1 toilet | A 6-person roofing crew: 1 unit |
| 20 or more | 1 toilet seat and 1 urinal per 40 workers | A 65-person crew: 2 standard units |
| 200 or more | 1 toilet seat and 1 urinal per 50 workers | A 260-person site: 6 standard units |

Does OSHA require hand-washing stations on jobsites?
OSHA 29 CFR 1926.51(f) requires washing facilities when workers apply paints, coatings, herbicides or insecticides, or work with other contaminants that can be harmful. The facilities must be close to the work and kept sanitary. Many general contractors require a station on every site anyway.
Our recommendation, which goes beyond the legal minimum, is 1 hand-washing station per 4 units on any site where crews eat lunch.
Are there exceptions to the OSHA toilet rule?
OSHA 1926.51(c)(4) says the toilet requirement does not apply to mobile crews that have transportation readily available to nearby toilet facilities. Road crews, utility crews and service techs who move between short stops may fall under this exception. Fixed jobsites do not.
When a site has no sanitary sewer, 1926.51(c)(3) calls for chemical, recirculating or similar toilets, which is what a porta potty is. Confirm any exception with your safety officer; this page is not legal advice.
What are the OSHA rules for farm and field workers?
OSHA 29 CFR 1928.110 covers agricultural field work with 11 or more hand-laborers. It requires 1 toilet and 1 hand-washing facility for every 20 workers, located within a quarter-mile walk of each worker, or within reach by vehicle where that is not practical.

How often should jobsite porta potties be serviced?
OSHA requires sanitary facilities but does not set a service interval. Weekly service is the industry standard and is included in every 28-day jobsite rental. Crews of 30 or more per unit, or hot summer weeks, often need twice-weekly service to stay clean.

Questions people ask before booking
Does a 3-person crew need a porta potty?
A fixed jobsite of any size needs at least 1 toilet unless the crew has quick transport to nearby facilities, such as a homeowner allowing use of a working bathroom.
Can workers use the homeowner's bathroom instead?
Only when the homeowner agrees and the bathroom is truly available all day. Most remodel contracts avoid this by renting a unit.
Do men and women need separate units?
Table D-1 counts total workers. Many sites add a separate unit marked for women when the crew is mixed; it is a good practice, not a Table D-1 requirement.
Does OSHA require a heated porta potty in winter?
OSHA does not require heated units. Winter units get an antifreeze tank solution so they keep working below freezing.
